Bentham's Context Principle in His Theory of Fictions?

以下の記述は単なるメモである。大したことは書いていない。


Quineさんによると、Benthamさんはcontext principleのようなものを主張していたらしい*1
Syncategorematicなwordsのみならず、categorematicなwordsも文脈的に定義し直すことができ、それによってcategorematicなwordsが指していると見える、ものなり対象なりの存在措定を拒否/消去できるという主旨のことを、Benthamさんの解釈としてQuineさんは提示されているようである*2


例えば

 ‘P unless Q.’ =Df ‘It is not the case that Q, then P.’

を(categorematicな語ではないが)‘unless’という語の文脈的定義の一つとする。そして左辺は右辺の省略形とでも考えるならば、右辺の文にこそ、左辺の内の語‘unless’のいみが見出されるだろう。しかしその右辺に‘unless’に相当する一つの単位をなした語がなければ、右辺の文全体のいみが左辺の‘unless’のいみを担っていると考えられる。大体ながらこのような感じで、文脈的定義を一種のcontext principleの現われと見ることが、もしかしてできるかもしれない*3


ところでBenthamさんによると、法的な概念を表わす基本的な言葉のあるものは擬制的な語 (fictitious/fictional terms) なのだそうである。つまりそのような語で表わされているのは、擬制なのだ、ということである。例えば“[legal] relation,”“right,”“power,”“possession”などは擬制的な語なのだそうである。例えばこんな具合である*4

Bentham's analytical and empirical method is especially obvious when one looks at some of his main criticisms of the law and of moral and political discourse in general. His principal target was the presence of "fictions"--in particular, legal fictions. On his view, to consider any part or aspect of a thing in abstraction from that thing is to run the risk of confusion or to cause positive deceit. While, in some cases, such "fictional" terms as "relation," "right," "power," and "possession" were of some use, in many cases their original warrant had been forgotten, so that they survived as the product of either prejudice or inattention. In those cases where the terms could be "cashed out" in terms of the properties of real things, they could continue to be used, but otherwise they were to be abandoned. Still, Bentham hoped to eliminate legal fictions as far as possible from the law, including the legal fiction that there was some original contract that explained why there was any law at all. He thought that, at the very least, clarifications and justifications could be given that avoided the use of such terms.

上記引用文中の‘In those cases where the terms could be "cashed out" in terms of the properties of real things, they could continue to be used, […]’辺りが文脈的定義に関する話なのだろう。


さて、2008年4月15日の日記で記した私の個人的疑問は以下のようだった。
Benthamさんはcontext principleのようなものを主張しているようであり、それは彼のfictionの理論でのことであるらしいのだが、なぜBenthamさんのfictionの理論がcontext principleにつながっているのか、またなぜBenthamさんはfictionについて論じ、しかもfictionの理論においてcontext principleなのか、であった。

今やこの疑問は、以上の記述から、大まかなところ、明らかであろう。

しかしここまで書いてきて何だが、まずは何よりBenthamさんのtheory of fictionsを直接読むことが優先されるべきだろう。
その方が事を理解するのに速くて正確であり、しかもずっとためになるだろう。
けれども、そこまでするのも今のところは大変なのでやめておきます。
何といっても本当はFregeを読まなければならないので…。

*3:文脈的定義をcontext principleと同一視することには問題があるだろう。両者がまったく同じだとは思われない。(大体、一方は定義だが、他方は定義ではない。) どこがどう違うのかを詳説することは、文脈的定義やcontext principleの勉強のためにいいかもしれないが、今はpassせざるを得ない。
